Article 1 - Definitions

In these terms and conditions, the following terms are defined as follows:

  1. Offer: all proposals and quotations from the company, available via the website or by e-mail.
  2. Supplier: The entrepreneur or consumer who offers a workshop via the online platform.
  3. Content: the event or workshop created by the supplier on the platform.
  4. Participant(s): The entrepreneur or consumer who registers for a workshop via the online platform.
  5. Service: use of the online platform.
  6. Provider: Bxl workshops.
  7. Right of withdrawal: the right of a consumer to cancel a distance contract within a statutory cooling-off period of 14 calendar days, in accordance with article VI.47 et seq. of the CDE.
  8. Effective date: the contract begins on the day of registration for one of the workshops, courses or products.
  9. Contract: the agreement between the supplier and the participant.
  10. Platform: the website where suppliers or Bxl workshops can publish their workshops or venues and where participants buy tickets.
  11. Products: tickets for, among other things, workshops, DIY kits, group workshops, online workshops... (this list is not exhaustive).
  12. Written: written communication such as an e-mail or registered letter if necessary.
  13. Website: www.bxl-workshops.com

Article 2 - Applicability of the general terms and conditions

2.1. These terms and conditions describe the rules under which we, as the Provider, will provide our services to the Participant. They apply to all workshop courses, contracts, services and products and contain important information about your rights and obligations.

2.2 These general terms and conditions always take precedence over any general terms and conditions of the Supplier, unless otherwise agreed in writing.

2.3. The latest version of these terms and conditions always applies.

Article 3 - Formation and performance of the contract - Payment

3.1. The Provider offers an online platform where the Provider or BXL workshops can offer its workshops or events and where the Participant can purchase tickets. To use the services of the platform, the Participant must register, after which he can purchase his tickets.

3.2. The Participant registers via the platform for a workshop or event. Payment must be made immediately unless otherwise agreed. In the event of non-payment, the registration will be cancelled. If the Participant wishes to receive an invoice, he/she must contact the Supplier directly, who will be informed of this request.

3.3. The conditions of cancellation, postponement or modification of the workshop, changes or cancellations at the request of the Participant (including the right of withdrawal for distance selling), unavailability or changes concerning the venue, force majeure, disputes, etc., are subject to the general terms and conditions of the Supplier concerned and the agreement concluded between the respective Suppliers (if applicable between the Workshop Supplier and the Participant or between the Workshop Supplier and the Venue). The Supplier may provide a specific cancellation policy, failing which the following will apply:

  • Cancellation by the Supplier: the Supplier may cancel the workshop at any time and will inform participants in good time. In this case, registration fees will be refunded by the Supplier.
  • Cancellation by the Participant: The participant may not cancel the workshop. He/she may, however, transfer the ticket to someone else, informing the Supplier so that the latter can expect another person.

3.4. The Participant/individual must be at least 18 years of age and legally capable. The person registering on behalf of a legal entity guarantees that he/she is authorized to act on behalf of the latter.

3.5. The Provider acts solely as an intermediary. The Participant enters into a contract directly with the Provider and expressly acknowledges that it does not enter into a contract with the Provider. The Provider cannot be considered the organizer or owner of the events offered by the Suppliers.

3.6. Each workshop or course has a limited number of places, indicated on the website. Once the maximum number has been reached, registration is automatically closed and it is no longer possible to reserve a place via the website.

3.7. If a workshop is fully booked, you can send an e-mail to join the waiting list. In the subject line of your e-mail, write "waiting list [workshop or course concerned]", together with your full name and telephone number. If a place becomes available, we will contact you as soon as possible.

3.8. By registering, you accept the terms and conditions.

3.9. Cancellations must be made by e-mail. For all cancellations, a €10 administration fee will be deducted. Cancellation procedures are as follows:

  • Up to 1 month (30 days) before start date: full refund minus administration costs.
  • Between 30 and 14 days before the start date: 50% of the participation fee will be retained.
  • Less than 14 days before the start date: 100% of the participation fee will be retained.
  • In case of no-show: no refund.

Article 4 - Cancellation/relocation by BXL Workshops

4.1. BXL WORKSHOPS reserves the right to cancel the workshop or course in the event of insufficient participants. You will be informed at least 7 days before the start date.

4.2. BXL WORKSHOPS may change the date of a workshop or course up to 2 weeks before the start date. You will be informed by e-mail and may postpone or cancel the workshop free of charge.

4.3 In the event of the teacher's illness, BXL WORKSHOPS may replace the teacher or cancel the workshop. In the event of cancellation, registration will be postponed or cancelled and course fees refunded.

4.4. The workshop will only take place if the minimum number of participants is reached, as indicated on the site. Otherwise, the workshop will be cancelled.

Article 5 - User account for the platform

5.1. No account is required to view workshops or purchase a ticket.

5.2 In the event of violation of the General Terms and Conditions or unlawful behavior, the Service Provider may prohibit access to the account without compensation.

Article 6 - Disputes

All complaints must be substantiated and sent by registered letter to the Provider within 2 weeks of the ticket purchase or workshop/event. Complaints concerning the workshop should be addressed to BXL workshops. Complaints received will be forwarded to the relevant suppliers.

Article 7 - Liability

7.1. Force majeure: The Service Provider is not liable in the event of force majeure. If the force majeure is temporary, the Service Provider will endeavour to fulfil its contractual obligations as soon as possible. If this is impossible, the contract will be revised or terminated by mutual agreement.

7.2. Relationships with third parties: The Service Provider is not liable for damages resulting from relationships with third parties.

7.3. Contractual failures: The Service Provider is not liable for damages except in cases of intentional fault or gross negligence. The Service Provider is never liable for consequential damages.

7.4. Technical problems with the website : The Service Provider does not guarantee that the website will be available for a certain period of time. The Service Provider will make every effort to ensure that the website is available again as soon as possible.

7.5. Safety during workshops: Suppliers and venue providers are responsible for the content, images and information published on the platform. The Provider is not responsible for any problems during or after the workshop. The Provider or supplier cannot be held responsible for loss, theft or damage to participants' personal property.

Article 8 - Intellectual property rights

8.1. The Participant acknowledges that all designs, information, images, e-mails, downloads, diagrams, modules, materials and other content on the Website are the property of the Provider and/or Supplier and are protected by intellectual property rights.

8.2 The Participant is prohibited from copying, modifying, publishing or using the content created by the Provider for direct or indirect commercial purposes. The Participant may download and print the works for strictly personal use.

8.3. The parties may always derogate from this rule by written agreement.

Article 9 - Data processing

9.1. By creating an account on the Platform, the Participant accepts these General Terms and Conditions and the Privacy Policy. The Provider must process personal data in order to create the user account or certain documents. The circumstances are described in the Privacy Policy.

9.2 All personal data obtained via the platform will be treated confidentially and will never be passed on to third parties unless necessary for the use of the Service. Data may be shared with other companies within the European Economic Area that are directly or indirectly related to the Service Provider.

Article 10 - Miscellaneous

10.1. BXL WORKSHOPS reserves the right to modify the content of workshops and courses or to change prices.

10.2. Parking and/or public transport costs are the responsibility of the participant.

10.3 In the event of disruption of a workshop by a participant, BXL WORKSHOPS reserves the right to exclude the participant without refund of fees paid.

Article 11 - General

11.1. The parties are bound by the confidentiality of confidential information obtained under this agreement.

11.2. No rights or obligations arising from these terms and conditions or our agreements may be transferred to a third party without the consent of the other party.

11.3 If any provision of these terms and conditions is contrary to a provision of law and therefore invalid, the other provisions shall remain in force. The parties undertake to agree on a new provision in line with the purpose of the invalid provision.

11.4. This contract is governed by Belgian law. Any dispute relating to the interpretation or execution of a contract and concerning our invoices shall fall within the exclusive jurisdiction of the courts where the Service Provider's registered office is located.

All bookings made via the BXL workshops website and under these terms and conditions are exclusively subject to Belgian law and jurisdiction. Any disputes will be submitted to the competent courts of Belgium.
